Terms of Use

These Terms of Use (“Terms”) govern your access to and use of TrackMatch (the “Site”), operated by TrackMatch. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Informational use only

The Site provides an informational assessment intended to help you compare GPS and equipment-tracking products. Recommendations are generated by a rule-based scoring system based on the answers you provide. They are intended to help inform, not replace, your own due diligence before making a purchasing decision.

2. Eligibility and acceptable use

The Site is intended for business users evaluating tracking products for their own organization. You agree not to: misuse the Site or attempt to disrupt its operation; scrape or systematically extract data from the Site other than through ordinary use; attempt to circumvent any access or rate limitations; or use the Site to build a competing product or service.

3. Third-party providers and links

The Site references and links to third-party vendors and their products. We do not control, and are not responsible for, those vendors' websites, products, pricing, availability, or practices. Some links are referral or affiliate links; see our Affiliate Disclosure for details.

4. Intellectual property

The Site's design, text, graphics, and underlying methodology are owned by TrackMatch or its licensors and are protected by applicable intellectual property laws. You may use the Site for your own informational purposes but may not reproduce, redistribute, or create derivative works from it without our prior written consent.

5. No warranties

The Site, and all recommendations, product information, and comparisons it provides, are offered “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Product features, pricing, and availability change over time and should be confirmed directly with the vendor.

6. Limitation of liability

To the fullest extent permitted by law, TrackMatch and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from or related to your use of the Site or any decision made based on its recommendations, even if advised of the possibility of such damages.

7. Indemnification

You agree to indemnify and hold TrackMatch harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.

8. Governing law

These Terms are governed by the laws of [Governing State/Country — confirm with counsel], without regard to its conflict-of-laws principles.

9. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the Site after a change becomes effective constitutes acceptance of the revised Terms.
